The Diversity Visa (DV) Program Suspension: What You Need to Know

Authored by Wendy R. Barlow, Esq.

What You Need To Know About the Suspension?

In a sudden shift to the U.S. immigration landscape, the Department of Homeland Security (DHS) announced on December 18, 2025, an immediate suspension of the Diversity Immigrant Visa (DV) Program, commonly known as the “Green Card Lottery.”

At Cohen, Tucker + Ades, we understand that this news brings significant uncertainty for those who have spent years dreaming of a life in the United States. Our team is closely monitoring these developments to help you navigate this changing environment.

Why was the program suspended?

The directive, issued by Secretary of Homeland Security Kristi Noem at the direction of the President, follows a tragic shooting incident in New England. The administration has cited national security concerns as the primary reason for the pause, stating a need to review the program’s vetting processes and merit-based criteria.

Who is affected by the pause?

The suspension is broad, and its impact is being felt across several stages of the immigration process:

  • Current Applicants: For those who were selected in the DV-2025 or DV-2026 lotteries and have applications pending with USCIS or at a consulate, processing is currently on hold.

  • Adjustment of Status: USCIS has been directed to pause the final adjudication of I-485 applications based on the Diversity Visa.

  • Future Entrants: Registration dates for the DV-2027 cycle, which typically occur in late autumn, remain unannounced and are effectively in limbo.

The Legal Landscape: Is this permanent?

It is important to remember that the Diversity Visa program is enshrined in federal law under the Immigration and Nationality Act (INA). While the Executive Branch has the authority to pause or review administrative processing for security reasons, a permanent cancellation of the program would likely require an Act of Congress.

We anticipate that this executive action will face immediate legal challenges in the federal courts, as previous attempts to unilaterally suspend Congressionally mandated visa programs have faced significant judicial scrutiny.

Exploring Your Alternative Pathways

If you were counting on the Diversity Visa, do not lose hope. The U.S. immigration system offers several other pathways for lawful permanent residency. Depending on your background, you may be eligible for:

  1. Family-Based Petitions: If you have a spouse, parent, or child who is a U.S. citizen or Green Card holder.

  2. Employment-Based Visas (EB-1, EB-2, EB-3): For professionals, skilled workers, or those with extraordinary abilities.

  3. National Interest Waivers (NIW): For those whose work significantly benefits the United States.

  4. Investment Visas (E-2 or EB-5): For individuals looking to start or invest in a U.S. business.
